Terms and Conditions
1. Introduction to our Terms of Use
PLEASE READ CAREFULLY AND BECOME FAMILIAR WITH THESE TERMS OF USE (THE ‘TERMS’) BEFORE USING THIS WEBSITE. BY USING THIS WEBSITE, YOU AGREE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND THAT THEY SHALL APPLY TO YOUR USE. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS, PLEASE LEAVE THIS WEBSITE.
Zoom Travel Ltd. owns and operates www.ifyouski.com (the "Site", "us", "we", "our" or "ifyouski.com"). This page informs you of our Terms and Conditions ("Ts & Cs" or "terms"). We are a specialist ski travel agency. We act solely as a booking agent on behalf of carefully chosen holiday/tour operators (also referred to as the ‘Principals’ or ‘Suppliers’) - further details of which will be made available at the time of booking. Therefore, all properties featured on this website are run and/or managed by the Principals. On making a booking via this website, the lead name on the booking (or the ‘group leader’) will enter into a contract with the Principal, and they will be bound by the Principal’s booking conditions which will govern all aspects of the holiday booked. If you would like details of any Principal before a booking is made, you must request this in writing.
It is the responsibility of the lead name to be fully aware of our Terms, all elements of the booking process and the Principal’s booking conditions. It is the lead name’s responsibility to also act on behalf of the whole group (or ‘party’) and they must be authorised to make and pay for the booking on behalf of all members of the party.
Information on this Site is owned by us or our licensors and all rights are reserved. You should not copy, publish or sell any information obtained from our Site although you are welcome to download and print out pages for your personal use.
We attempt to explain everything we do in the simplest possible terms using everyday language; however, if there is anything that needs clarifying regarding these Terms or the booking process then please refer to these Terms of Use, see our FAQs or contact us.
2. ifyouski.com, ABTA and Advantage
Zoom Travel Ltd., trading as ifyouski.com are a member of the Advantage Travel Partnership and with this, we have our own ABTA (P6734) meaning you have the benefit of ABTA’s assistance and Code of Conduct.
We act as an agent for various tour operators and all travel contracts will be between you and the tour operator of such holidays.
3. Our Travel Partners
Holidays displayed on this website, which include flights in the package, are provided by a holiday/tour operator with an ATOL license; those shown without flights included in the price are run independently of ATOL. If you book accommodation only i.e. with no transport elements included in your booking, Atol protection will NOT apply. The terms ‘Travel Partner’, ‘Principal’ or ‘Supplier’ refer to any holiday/ tour operator whose holidays or service we can sell. We also feature some paid listings i.e. where a chalet owner has paid us for the right to feature their property(s) on our site. If you enquire about one of these properties, your enquiry will be passed directly to the owner/operator who will handle your enquiry and any booking arising from it. You must ensure that in such a case, you are satisfied that the owner/operator has adequate financial protection in place. If you book any property on this basis, you will NOT be protected by our ABTA Membership as your booking is not placed through us.
Neither we, nor our Travel Partners nor any other third party provider of either flights or holidays accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of:
- • your use of or reliance on any content available on or through this website,
- • any failure to access or delay in accessing this website or
- • the performance or non-performance of any services by our Travel Partners or third party providers of flights, holidays or services.
Our liability and that of our Travel Partners shall be limited in respect of direct loss (except in the case of personal injury or death, in respect of which there is no limit) to a maximum of the price of the product or service to which the claim relates.
If any of these Terms (including exclusions), in whole or in part, are found to be unlawful, void or for any other reason unenforceable, that exclusion or part thereof shall be deemed severable and shall not affect the validity or enforceability of the other exclusion(s) or part(s) thereof in question.
4. The Group Leader and the Principals Contract
The group leader (or lead name on the booking), on behalf of all members of the party, will be bound by the Principal’s contract and booking conditions, which governs all aspects of the holiday. Zoom Travel Ltd. acts as a booking agent on behalf of the Principal. The group leader is strongly urged to refer to the Principal’s current website or brochure before a booking is made. If you would like a copy of these, you can request this at any time.
The group leader is responsible for the full cost of the holiday and therefore must have the authority from every member of the group to pay for the holiday on their behalf. This will include any subsequent changes to holiday costs if applicable, for example any cancellation charges or add-ons. Any refunds will be made directly to the group leader’s bank account.
We require full details of the group leader, including title, name (as per passport), full contact details (address, phone numbers and email address) and any other personal details that may be requested by the holiday/tour operator and/or airline. These details will be used as the primary source of contact during the enquiry, booking and pre-holiday process.
It is the group leader's responsibility to notify us in writing of any change to their personal contact details.
We only act on the instruction of the group leader and therefore, following a booking, will only communicate with them. We will not change any aspect of the booking by verbal instruction only – any amends will only be made following written confirmation from the group leader from the group leader’s registered email. They must inform the other members of the party of any amendments to the booking, costs or travel arrangements.
It is the group leader’s responsibility to collect all group names and send these and any specific requests (for eg dietary requirements) to us by the group leader’s registered email. It is also the group leader’s responsibility to ensure that each passenger on the booking has a valid passport, the correct visa requirements and suitable travel insurance.
On booking, the group leader agrees that all relevant personal information for each group member may be forwarded to the appropriate holiday/tour operator.
5. Holiday Prices Advertised
The prices displayed on this website are per person per week, in UK pounds Sterling (£) and are based on full occupancy of the lowest priced room available, unless otherwise stated. Additional room, flight or other supplements may be added on, or any group discounts, special offer deals or other reductions may be subtracted from the basic holiday costs, which you will be advised of at a suitable time during your enquiry. The advertised price may or may not include return flights and/or resort transfers; the travel arrangements, catering and other services included in the price is described on each property page, but is subject to availability. The advertised price of the holiday does not generally include ski carriage, equipment hire, travel insurance, lift passes, in-resort services, lunchtime food or an 'open bar' unless otherwise clearly stated in the description.
Late ski deal prices are displayed per adult per week and are for the lowest priced room available in the advertised accommodation, based on the maximum occupancy of that particular room or accommodation. If flights are included in the package, then these may be from any UK airport. Other room, flight or additional supplements may be added on to these prices.
The prices displayed on this website or quoted in any verbal communication or email correspondence are indicative only and may change at any time until we send you the Principal's invoice.
The price quoted for any holiday is based only on the information that you have given us and therefore we cannot be held responsible for any exclusions or omissions due to lack of information provided by you.
Certain holiday/tour operators collect a small local tourist tax per person, charged by some resorts, which are usually payable to your accommodation hosts during the holiday. These may not be included on the final holiday booking invoice.
We reserve the right to correct errors in both advertised and confirmed prices.
In occasional circumstances we may apply an admin fee to a booking.
6. Childs/Infants Prices
We do not generally advertise child prices, as the definition of a ‘child’ varies depending on the holiday chosen and therefore the supplier. The age of any child travelling, on the final day of the holiday must be stated in order for us to quote correctly. If this information provided is incorrect the child price may well increase, including any associated supplements, even following full holiday payment.
7. Special Offers and Discounts
Special offers or discounts cannot usually be used in conjunction with any other offer or discount. They are subject to availability and may change or be withdrawn at any time without notice. Additional room or other supplements may apply.
Any special offers and/or discounts that may apply to a holiday booking must be arranged prior to booking and be validated in the group leader's booking confirmation email sent from us. Special offers and/or discounts cannot be applied following a booking confirmation.
8. Group Discount
Maximum group discount can only be offered if the group leader pays for the holiday in a one-off payment. We can collect payment from different members of the group, but additional charges may be made for separate payments.
Please be aware that if you originally benefited from a group discount and your group size decreases from the original, the group discount may be affected. Group discount is calculated using the group size at the time of the original booking being made. Adding members to a group may not necessarily qualify that group for any extra group discount.
9. Holiday Prices
Very occasionally, and usually only in exceptional circumstances, the cost of a holiday can increase following a booking, subject to the Principal’s terms and conditions. This is completely beyond our control but you will be informed of any increase prior to your holiday start date. We are unable to refund the difference in cost of a holiday if this is the case.
All holidays purchased via us are governed by the Consumer Protection (Distance Selling) Regulations 2000. These make reference to refunds, travel date changes or cancellations NOT being made free of charge, following a holiday booking. All cancellations to any holiday booking are subject to the Principal’s terms and booking conditions.
10. Holiday Payments
If the holiday is booked more than 12 weeks prior to the start date of the holiday then a deposit payment is required, usually on a per person basis to secure the booking. At 12 weeks (or less if booking within this period), the final balance is due.
Payments can be made over the phone by debit or credit card during the booking process or by bank transfer. There are no surcharges on any card payments when paying your deposit. We do not accept credit card payments for final balances. Final balances can be paid by debit card or bank transfer. Note that our membership of ABTA means that you are fully protected when paying by bank transfer. Any special bank charges incurred such as foreign transfer costs, must be covered by you.
We can collect deposit or final payment from different payment cards, but there may be an admin charge of £10 per additional card used.
If the final balance is not received 12 weeks prior to the holiday start date, then we reserve the right to:
a) charge £5 per day for every adult payment overdue (plus any additional admin charges for further reminder notices issued) and/or
b) cancel the holiday with full loss of deposit.
Within 12 weeks of departure, the full balance of the holiday is due upon booking.
11. Dietary Requirements
Vegetarian, vegan or other dietary requirements can be catered for in most of the accommodation sold on this website, but this must be discussed with our staff before a booking is made. Some dietary requirements may incur an additional charge. Any dietary requirement will be confirmed with you at the time of booking and will be noted on your confirmation invoice; it is your responsibility to ensure that any dietary requests are correctly recorded on the booking confirmation email and the invoice. We cannot be held responsible for the lack of provision of a specific requirement, or any charges made in resort by the holiday/tour operator if these requirements are not confirmed in writing with you before the start of the holiday.
12. Special Requests
If you or any member of your group have any special requests or require a particular facility or service that is either important or essential to the enjoyment of your holiday, then this needs to be requested in writing and confirmed by us before the booking is made. We cannot guarantee that your request will be met and we will have no liability if this is not met but we will strive to ensure that our suppliers can meet your request.
13. Ski/Snowboard Carriage
Ski or snowboard carriage cannot be guaranteed as each flight has a limited allowance. Therefore if ski or snowboard carriage is required, this must be mentioned during the enquiry and reserved and confirmed at the time of the holiday booking. There may be an additional charge for ski carriage.
14. Property Descriptions and Catering Information
All our chalet and hotel descriptions are taken from the information as provided by the holiday/tour operator. These are updated, amended or changed regularly and we therefore take every reasonable care to ensure that the information published is accurate. We cannot accept liability for any errors or omissions in any documentation or the accuracy of the descriptions, except where those errors are made by ourselves.
15. Facilities / Services / Amenities
Certain advertised facilities, services or amenities (such as TV, internet access, hot tubs, resort guiding etc.) cannot be guaranteed to be fully functioning or accessible. Occasionally, some facilities may be temporarily unavailable, or their use may be restricted due to operational reasons. Where this happens we will do our best to advise you as soon as possible. As we are the booking agent only, and your holiday is run and/or managed by the holiday/tour operator, you need to refer to their terms and conditions regarding this.
16. Familiar Ski Terms, Descriptions and Phrases
We try to standardise the terms used to describe a property, its facilities, the resort etc. but as we work with so many different holiday/tour operators this is not always easy. Below, therefore, are our interpretations of some of the more common phrases as used on this website. For an exact definition of the meaning please refer to the holiday/tour operator’s brochure or website. If any of the features listed below, or others, are an important factor in holiday choice then please ask us to clarify before booking.
-"En-suite / Private facilities" We regard this as a bedroom with an attached room containing a WC and/or bath and/or shower or containing these facilities within the room itself. A bedroom having 'private facilities' does not always mean en-suite but implies that it has its own separate facilities that are exclusive to the occupants of that room.
-"Ski in/ski out" Some accommodation are described by some holiday/tour operators as 'ski in/ski out' if they are within 70 metres of an accessible skiable area linked to the main resort, where as others only describe this as a feature if the accommodation is literally on the piste. We would describe this term therefore as a property having very good piste or slope access, for an intermediate skier in normal snow conditions. Slope access however may not be an official pisted route.
-"Sole Use" / "Exclusive Use" Any accommodation booked on a 'sole use' basis, or for your group’s 'exclusive use', means that your group will be the only guests staying in the property for the duration of your holiday. Please be aware that the staff/owner may have living quarters in the property or may use a communal part of the property for their own use (eg the entrance).
-“Distance to town” This should be used as a rough guide only and is given in metres from the property to the edge of the town/resort/main resort area. If a distance to town is not provided by the holiday/tour operator, but a walking time is given, we will use the simple formula of a 1 minute walk being approx. equivalent to 100m.
17. Photos, Images and Floor Plans
The photos, images and floor plans used on this website have been provided by the supplier of the holiday, and occasionally from our own photo library. We aim to accurately represent the accommodation with the help of the most recent photos, but due to recent refurbishments or re-designs these may not be an exact representation of the accommodation. We cannot therefore be held liable for any information acquired regarding any facilities, layout, design or décor from the use of the photos alone.
18. Google Maps and Locations
Whilst we strive to keep our map data accurate and current, we cannot accept any liability for any loss, damage or inconvenience caused by reliance on any information, or omissions in the data supplied. The information should be used for personal, non-commercial use only. Please also refer to Google Maps Terms of Service. Any inaccuracies in the data found, please contact us and we will endeavour to correct it as soon as possible.
19. Accommodation Ratings
The overall accommodation rating is to be used as a guide only, and is based on a scale from 1 to 5. It is based upon our subjective opinion together with those of the holiday/tour operator which include the following factors:
a) The facilities, services and amenities as advertised for the property b) The location of the property, in regards to ski accessibility and proximity to town or amenities c) Age, décor and design of the property d) Guest satisfaction feedback on the holiday/tour operator e) The official star rating of the property
The rating given by us is not an official rating. Where an official star rating exists, this may be included in the property description.
20. Ski Resort Information and Ratings
Ski resort information and the resort ratings as advertised should be used as a guide only. We cannot accept liability for any errors or omissions in the accuracy of the descriptions. It is recommended that you either phone one of our experienced staff or visit the official resort website if further information regarding a ski resort is required. Resort ratings and statistics shown for a particular resort may be inclusive of the whole regional ski area or domain.
21. Booking Confirmation
Please note that holiday details or prices that you may have been sent prior to booking at an earlier stage of your enquiry may have changed without notice; the onus is on the group leader to check all details are as expected when the booking is made. Only those persons named at the time of booking, or subsequently advised, can occupy the accommodation.
22. Travel Insurance, Passport and Visa Requirements
It is the group leader's responsibility to ensure that each party member has the correct travel insurance, a valid passport and relevant travel documents for your destination.
We strongly recommend having a travel insurance policy in place as soon as you have booked your holiday.
The correct travel insurance is essential in order for you and each member of the group to travel on your ski holiday. Please read carefully the holiday/tour operator’s terms and conditions on the subject of travel insurance. If you travel without insurance you may be in breach of your tour operator's Ts&Cs. We cannot accept any responsibility for you in the event that you or any member of your party travels without adequate insurance. Please be aware that we cannot advise you on your travel insurance policy.
23. Flight Times and Flight Details
If the holiday is shown to include flights in the price, then these are based on flights departing from the specified UK airport. All flight details given in any correspondence are subject to availability and to be used for guidance only.
Even following a booking confirmation, any flight times listed are provisional and are subject to change. The provisional scheduled times will be shown on your booking invoice, however, the confirmed flight times will be those shown on your tickets, which will be dispatched to you approximately 7 days before the start of your holiday. We will check these but it is ultimately your responsibility to check the confirmed flight times as issued on your tickets. Flight times may change even after tickets have been issued; if this is the case we will contact you as soon as possible to inform you of any change. Flight times given are local times to the country of departure and arrival.
We cannot guarantee the airline or the destination airport as this information is subject to change at any time even following a holiday booking.
Any change to the flight details does not entitle you to any refunds or the right to cancel or change the holiday arrangements without paying the normal charges.
24. Passenger Details
We require full details for all group members, which include title, first name and surname, date or birth, dietary requirements and any other personal details that may be requested by the holiday/tour operator or airline. The group leader is required to provide all group names and associated group particulars as required, by email. Completing this by email ensures that the holiday operator receives the exact information as written by the group leader. In some circumstances the group leader may have to complete a tour operator’s booking form.
25. Name Change / Late Names
Group member information is used, amongst other things, for the issuing of tickets. Therefore if any group member information provided is incorrect, needs amending or is late, a charge will be applied. The same applies to any name change following a booking.
26. Change of Accommodation
Very occasionally, the accommodation booked is withdrawn by the holiday/tour operator. In these circumstances an alternative accommodation or a refund may be offered according to their terms and conditions. If a refund is offered, and is the chosen option, then we will strive to find you alternative accommodation arrangements using our other suppliers. Zoom Travel Ltd. cannot accept any liability for any additional costs incurred due to the change of the holiday details.
27. Cancelled Holidays
All holidays purchased via ifyouski.com are done so under the Consumer Protection (Distance Selling) Regulations 2000. These state that refunds, date changes or cancellations cannot be made free of charge, following a holiday booking.
If group members or holidays do need to be cancelled, the request must be made in writing by the group leader only; you will then be advised of the full cancellation costs prior to this being actioned. Cancellations and costs are based on the tour operator's terms and conditions. Please note, that there will also be an ifyouski.com cancellation fee of £25 per person cancelling, on top of any charges levied by the tour operator. Please also refer to the above paragraph in relation to group discount being potentially affected. We cannot accept verbal cancellations, nor can we accept cancellations from anyone other than the group leader.
If your booking includes scheduled flights, the tour operator's cancellation charges may include full cancellation costs for the flights.
For example, if you have paid a deposit of £800 but the total cost of the flights on your booking is £1,500, the tour operator's Terms & Conditions may mean that you are liable to pay the difference. In this example, if cancelling your holiday after paying the deposit but BEFORE paying your final balance, you would be required to pay the additional £700 (i.e. the difference between the deposit paid to date and total cost of the scheduled flights) upon cancellation.
Similarly, some tour operators may levy a cancellation charge equal to a set percentage of your holiday cost. Occasionally, this cost can exceed the amount of the deposit paid at the time of booking. In this instance, upon cancellation of your booking you may be required by the tour operator to pay the difference between your deposit and their set cancellation percentage i.e. 25%.
If you are unsure as to whether your booking may be affected by this, PLEASE ASK your sales consultant at the time of placing your booking.
